Federal Privacy Act 1988 Section 94H Requiring the use of COVIDSafe

1) A person commits an offence if the person requires another person to:

  1. download COVIDSafe to a communication device; or
  2. have COVIDSafe in operation on a communication device; or
  3. consent to uploading COVID app data from a communication device to the NationalCOVIDSafe Data Store.

Penalty: Imprisonment for 5 years or 300 penalty units, or both.

2) A person commits an offence if the person refuses to allow another person to enter:

  1. premises that are otherwise accessible to the public; or
  2. premises that the other person has a right to enter

on the ground that, or on grounds that include the ground that, the other person:

  1. a)  has not downloaded COVIDSafe to a communication device; or
  2. b)  does not have COVIDSafe in operation on a communication device; or
  3. c)  has not consented to uploading COVID app data from a communication device to theNational COVIDSafe Data Store.

Forcing any medical procedure on us is Unconstitutional

The Covid restrictions being imposed by State governments are actually Unconstitutional. 

Unconstitutional, because in 1946 the Australian People voted in a Referendum to amend the Commonwealth of Australia Constitution Act 1901 Section 51 of the Constitution to insert the following amendment:

(xxiiiA) the provision of maternity allowances, widows’ pensions, child endowment, unemployment, pharmaceutical, sickness and hospital benefits, medical and dental services (but not so as to authorize any form of civil conscription), benefits to students and family allowances;

Q1. The referendum was carried.
All six States recorded a YES vote. Nationally 54.39% of electors voted YES

The question was approved, but with a condition:
(provide) medical and dental services (but not so as to authorize any form of civil conscription)

This means that it is unconstitutional for anyone to force anyone else to accept any medical treatment. 

The Law Insider dictionary defines medical treatment:
Medical treatment means the management and care of a patient for the purpose of combating disease, injury, or disorder. Restrictions on activities are not considered treatment unless the primary purpose of the restrictions is to improve the worker’s (sic-anyone;s) condition through conservative care.

Section 109 of the Constitution protects us from State governments passing laws that do not agree with Federal Law. In other words, a State cannot pass a law that contradicts a Federal Law.

Your Privacy is guaranteed

Our privacy is protected ty the Privacy Act 1988, and Section 94H specifically protects us from the State government Covid directives (a Directive is not a law) forcing people to obey the Covid restrictions. This law not only states that we cannot be forced to scan in using a QR code before entering a business premises, but it provides a 5 year penalty if a business forces you to. 

And it provides another 5 year penalty if they refuse you entry. 

Section 94H of the Privacy Act 1988

94H Requiring the use of COVIDSafe

  1. A person commits an offence if the person requires another person to:
    1. download COVIDSafe to a communication device; or
    2. have COVIDSafe in operation on a communication device; or
    3. consent to uploading COVID app data from a communication device to the National COVIDSafe Data Store.

Penalty: Imprisonment for 5 years or 300 penalty units, or both.

  1. A person commits an offence if the person:
    1. refuses to enter into, or continue, a contract or arrangement with another person (including a contract of employment); or
    2. takes adverse action (within the meaning of the Fair Work Act 2009) against another person; or
    3. refuses to allow another person to enter:
      • premises that are otherwise accessible to the public; or
      • premises that the other person has a right to enter; or
    4. refuses to allow another person to participate in an activity; or
    5. refuses to receive goods or services from another person, or insists on providing less monetary consideration for the goods or services; or
    6. refuses to provide goods or services to another person, or insists on receiving more monetary consideration for the goods or services;

on the ground that, or on grounds that include the ground that, the other person:

  1. has not downloaded COVIDSafe to a communication device; or
  2. does not have COVIDSafe in operation on a communication device; or
  3. has not consented to uploading COVID app data from a communication device to the National COVIDSafe Data Store.

Penalty: Imprisonment for 5 years or 300 penalty units, or both.

  1. To avoid doubt:
    1. subsection (2) is a workplace law for the purposes of the Fair Work Act 2009; and
    2. the benefit that the other person derives because of an obligation of the person under subsection (2) is a workplace right within the meaning of Part 3‑1 of that Act.

What is the protection?

An employer must not take adverse action[1] against an employee or prospective employee, on the grounds that they:

  • have not downloaded COVIDSafe to a communication device
  • do not have COVIDSafe in operation on a communication device, or
  • have not consented to uploading COVID app data from a communication device to the National COVIDSafe Data Store.

Example

An employer must not dismiss an employee or refuse to employ a person because they haven’t downloaded COVIDSafe. 

Are there exceptions?

There are no exceptions.

Coercion

Section 343

  1. A person must not organise or take, or threaten to organise or take, any action against another person with intent to coerce the other person, or a third person, to:
    1. exercise or not exercise, or propose to exercise or not exercise, a workplace right; or
    2. exercise, or propose to exercise, a workplace right in a particular way.
  2. Subsection (1) does not apply to protected industrial action.

What is the protection?

A person must not organise, take or threaten any action against another person to force that other person, or a third person, to:

  • exercise or not exercise a workplace right
  • propose to exercise or not exercise a workplace right, or
  • exercise or propose to exercise a workplace right in a particular way.[1]

Example

An employer must not threaten an employee with demotion unless the employee stops a harassment claim against their supervisor. 

Are there exceptions?

This protection does not apply to organising (or threatening) protected industrial action. 

What is coercion?

A person coerces another to act in a particular way if the first person brings about that act by force or compulsion. Coercion will cause a person to act in a way that is non-voluntary.[2]

There must be two elements to prove ‘intent to coerce’:

  • it needs to be shown that it was intended that pressure be exerted which, in a practical sense, will negate choice, and
  • the exertion of the pressure must involve conduct that is unlawful, illegitimate or unconscionable.[3]

Coercion is distinguished from other concepts including influence, persuasion and inducement. Coercion implies a high degree of compulsion and not some lesser form of pressure where a person is left with a realistic choice as to whether or not to comply.[4]

Coercion may take many forms. Persuasion becomes coercion when a person who influences another does so by threatening to take away something they possess, or by preventing them from obtaining an advantage they would otherwise have obtained.[5]

The prohibition applies irrespective of whether the action taken to coerce the other person is effective.[6] However, the actual effect of conduct may indicate the intent or purpose of the alleged contravener when the action was taken.[7]

MANY women are posting reports of disrupted and unusual menstrual cycles, heavy bleeding, and miscarriages.

What’s more, some of these women haven’t received the COVID vaccine, but they’ve been in close contact with others who have been vaccinated—leading to the question:

Can the COVID vaccine (which is actually an experimental genetic treatment) “shed” something harmful that can be passed from person to person?

Perhaps that sounds impossible, but in the world of genetics, much can go wrong.

In fact, for the past 25 years, we’ve had an illustration of shedding right in front of our eyes: GMO crops.

If you recall, Monsanto assured one and all that these crops—genetically engineered to survive the sprayed herbicide Roundup—would flourish, while weeds would succumb to the chemical.

So what actually happened? The weeds were resistant and became super-giants. And the Monsanto genes drifted from farm to farm, contaminating crops that were never meant to be engineered.

The Monsanto genes were “shed” and they spread.

This spread was not only the result of obvious cross-pollination. Bacteria in the soil, and in human digestive systems, also picked up and incorporated the Monsanto genes.

Why couldn’t “shed and spread” occur with a genetic COVID vaccine?

The COVID injection contains a piece of RNA. The RNA nanoparticles enter human cells, forcing those cells to manufacture a protein similar to a protein in the purported SARS-CoV-2 virus. The immune system mounts a neutralizing attack against that protein, thus “rehearsing” to defeat the virus if it comes along later.

That’s the hypothesis.

In practice, who knows how many different dangerous and harmful processes can be detonated in the human body—plus the drifting of those genetic effects from person to person, whether vaccinated or not.

Yes, I know the experts will point out the difference between inserting genes into crops and inserting them into humans. They’ll say the GMO crops are supposed to hold on to those new genes long-term, but the COVID injection only has short-lived genetic effects.

Supposedly, this is true. Supposedly.

Why take the risk? 

If you are not sick, why would you let a stranger inject an unknown, untested substance into your body? It just doesn’t make sense, does it?

find some vaccination clinic where masses of people are being injected by low-level medical technicians, rather than actual doctors. make sure that you can have it done in a semi-private space. at the critical moment, pull out five $100 bills, and make it clear by gesture that they can go in the technician’s pocket if the needle doesn’t go in your arm. make sure that all the paperwork is properly filled out, and then depart.

congratulations. you are now recorded in the government’s vaxx database, which is all that will ever matter. whatever QR-enabled electronic vaxx passport they come up with, you’ll be on the winning side of it.

But even better a strategy than lying is playing stupid. If you speak more than one language, use the one your establishment interlocutor doesn’t understand. Make a total dimwit of yourself. They won’t be able to move you an inch. Think The Good Soldier Schweik (read it if you haven’t). Alternatively, follow instructions/orders to the most absurd extreme.

OK, now we have some way to progress. We’ll be setting up an image database of these ridiculous barcodes for checking in to your local pub/gum/train station etc. It will rely on people submitting images.
If people contribute and use it will rapidly pollute the database.

If you’re in the US, OSHA may be your best bet. Some time ago they commented that employers who mandated the vax wd be responsible legally for any harm. That might calm an employer’s zeal. One could present an employer with a notarized memo that if one took the vax it wd be under compulsion and in that case any harm resulting . . . . etc

You can probably find the OSHA document online. Then you send the whole thing by certified mail, and insist that if they require the vax they must inform you in writing. 

But of course if they still don’t blink then you’ll have to change jobs.

In Hong Kong we have mandatory contact tracing: every restaurant, government department, business office and various other places, they display a QR code and you are supposed to register it with your “Leave Home Safe” government tracking app or sign in on paper.

Yesterday, for the first time, I went to a bar that would not allow me to sign in on paper, I had to use the government app. The business was mostly empty and when the owner insisted on me using the app, I told him that would not be possible as I was not carrying a smart phone. He lost out business.

A small group of wankers think it is their job to step up the fight against Covid by applying even more draconian laws than those required by government. I avoid their businesses and, by the look of that place yesterday, so do others. However, there are many businesses that just do not bother implementing the tracking nonsense: I search out and support those businesses.20 Reply

Yep… its about tightening the noose and conditioning people for vaccine passports. I will not do any contact tracing anywhere, and I realise how tough things are going to get.
From May 28th it’s compulsory for businesses in Melbourne to have contact tracing, tho I think that only applies to hospitality venues like pubs and restaurants and not for supermarkets. Yet.
I’ll do what you’re doing and search out small businesses that are not gung ho about implementing this. Gotta go as am working at present. Have a good week A
